Business mediation

Business conflicts are often complex and legal in nature, while the stakes are high. Remediate Mediation guides national and international business partners towards conflict resolution and relationship repair. Remediate Mediation offers professional assistance in finding quick, affordable and sustainable solutions. Business disputes can for example be about:

  • Breach of trust between board members
  • Discussions about (re)allocation of tasks within an association
  • Conflicts between medical specialists
  • Disputes regarding interpretation of (partnership) contracts.

WHY A NEUTRAL PARTY IN BUSINESS MEDIATION CAN BE VALUABLE

As a neutral and independent process facilitator, the mediator helps parties resume stalled communication. For those involved, the issue is often of great importance and somewhat confusing. Emotions run high and the issues at play get mixed up. Given her experience as an employment lawyer, legal counsel and manager, Carola helps those involved to get a grip on the matter. Insight into what is really important to them and therefore needs to be addressed in the solution. When parties regain control of the situation and start truly listening to each other again, an important first step has been taken: a step towards mutual understanding, de-escalation and – ultimately – a joint solution to the dispute. This normalizes valuable relationships and avoids costly, legal proceedings.

HOW DOES BUSINESS MEDIATION WORK AT REMEDIATE MEDIATION?

On average, 4 to 6 conversations are needed to resolve a conflict. Sometimes, after a successful first meeting, fewer meetings are needed as the conflict has already been de-escalated. For more complex cases, the number of meetings may be higher. Prior to the joint mediation sessions, an introductory meeting takes place between Carola and each party separately. The first joint meeting is only scheduled if both parties indicate they wish to continue the mediation. During the joint conversations, the parties sit at the table together with Carola. If they like, the parties can bring a confidant or advisor along, but this is not necessary. The conversations last 2 to 2.5 hours on average. At the end of each conversation, Carola confirms the agreed upon action points in writing and a follow-up meeting is scheduled. A successful mediation is concluded with an appointment overview or a written agreement signed by the parties. Would you like to find out what business mediation can do for you?
